These Terms & Conditions ("Terms") govern your access to and use of the website located at https://www.pinksync.org/ (the "Site") and any related services, community programs, and initiatives provided by Pink Sync ("Pink Sync," "we," "us," or "our"), a Utah nonprofit organization located at 2718 N Deer Meadow Dr, Lehi, UT 84043.

By accessing or using our Site, registering for our programs, or making a donation, you agree to be bound by these Terms. If you do not agree, please do not use our Site or participate in our programs.

1. Medical & Healthcare Disclaimer

THE SITE AND OUR SERVICES DO NOT PROVIDE MEDICAL ADVICE.

  • Educational & Peer Support Only: Pink Sync offers peer support, community connectivity, educational resources, and practical aid (such as Kitchen SYNC meal distributions). While medical specialists, surgeons, therapists, and healthcare providers may participate in our events (such as Summit Strong) or contribute content, all material on the Site and provided through our programs is for informational, educational, and support purposes only.

  • No Doctor-Patient Relationship: Interacting with Pink Sync, participating in our programs, or attending our events does not create a physician-patient, therapist-patient, or healthcare provider relationship.

  • Consult Your Care Team: Always seek the advice of your physician or qualified healthcare provider with any questions regarding a medical condition, diagnosis, treatment, or nutrition plan. Never disregard professional medical advice or delay seeking it because of something you read on this Site or heard at a Pink Sync event. In a medical emergency, call 911 or your local emergency services immediately.

2. Intellectual Property Rights

All content on this Site—including text, graphics, logos, images, program names, resource directories, and website code—is the property of Pink Sync or its content suppliers and is protected by applicable trademark, copyright, and intellectual property laws. You may view, print, and share materials from the Site for personal, non-commercial use only, provided you retain all copyright and proprietary notices.

3. Events & Program Registration

  • Free Participant Access: Unless explicitly stated otherwise, Pink Sync events and support programs are provided free of charge to participants and survivors.

  • Accurate Information: When registering for events or applying for programs, you agree to provide truthful, accurate, and current information.

  • Media Release: By registering for or attending Pink Sync events, you acknowledge that photography, audio recording, and video recording may occur. You grant Pink Sync a royalty-free, perpetual license to use your image, video footage, voice, and likeness captured during events for organizational, promotional, educational, and marketing purposes across print, online, and social media platforms.

4. Donations & Financial Contributions

  • Final Contributions: All online and offline financial contributions made to Pink Sync support our tax-exempt nonprofit mission and operational programs. All donations are voluntary, non-refundable, and final, except in cases of clear administrative or processing errors.

  • Processing Errors: If you believe a donation was processed incorrectly or made in error, please contact us promptly at cami@pinksync.org.

5. Third-Party Services & External Links

Our Site contains links to external websites, local health providers, and program delivery partners (such as Citrus Pear for meal fulfillment). Pink Sync does not control or assume responsibility for the content, security, or practices of any third-party websites or services.

 

6. Limitation of Liability & Indemnification

  • To the fullest extent permitted by law, Pink Sync, its officers, directors, volunteers, and partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site, participation in our programs, or reliance on any content provided.

  • You agree to indemnify and hold harmless Pink Sync from any claims, liabilities, or expenses arising from your misuse of the Site or violation of these Terms.

A. Information You Provide Directly

  • Contact & Registration Details: Name, email address, telephone number, and physical shipping/mailing address when filling out contact forms, signing up for newsletters, or registering for events (such as the annual Main Event).

  • Program & Health Status Information: When applying for support initiatives like Kitchen SYNC / Rescue Meals, you may voluntarily provide sensitive health and treatment information (such as current breast cancer treatment status, dietary requirements, and household family size) to help us determine eligibility and deliver aid.

  • Donation & Payment Information: Payment card details, billing address, and transaction amounts when making online financial contributions. Online payments are processed securely through our platform host (Wix Payments and integrated gateways). Pink Sync does not directly store complete credit card or bank credentials on our servers.

B. Information Collected Automatically

  • Analytics & Cookies: Our Site utilizes standard tracking technologies, including Google Analytics and Meta Pixel (Facebook Pixel), to collect information about visitor browsing behavior, IP addresses, browser type, referring URLs, and page engagement. This helps us optimize site performance and improve community outreach.

  • Cookie Preferences: You can manage or disable cookies through your web browser settings at any time.

  • Fulfilling and administering community support services (e.g., coordinating meal prep and delivery for Kitchen SYNC).

  • Program Fulfillment Partners: For specific support programs such as Kitchen SYNC, recipient contact details (name, delivery address, phone number, and relevant dietary notes) are shared directly with our meal preparation partner, Citrus Pear, solely to coordinate meal delivery logistics.

  • Platform & Service Providers: We use Wix for site management, forms, email communications, database handling, and payment processing. Data processed through Wix is governed by Wix's security and privacy standards.

  • Legal Requirements: We may disclose personal information if required by law, subpoena, or government order, or to protect the safety, rights, or property of Pink Sync and our community.

4. Text Messaging (SMS) Compliance

If you provide your mobile phone number and opt in to receive text updates or event reminders via Wix/Pink Sync:

  • Consent: You agree to receive SMS text messages regarding event notifications, program reminders, or organizational updates.

  • Privacy Assurance: Mobile information and SMS opt-in consent will not be shared with third parties or affiliates for marketing/promotional purposes.

  • Opt-Out: You can opt out of SMS communications at any time by replying STOP to any text message received. Message and data rates may apply depending on your cellular provider.

We treat health-related disclosures (such as breast cancer treatment status submitted for Kitchen SYNC) with strict confidentiality. Access to sensitive health data is restricted to authorized Pink Sync personnel and fulfillment partners strictly involved in administering recipient support. We maintain appropriate administrative, technical, and physical safeguards to prevent unauthorized access, loss, or disclosure.

  • Retention: We retain personal information for as long as needed to fulfill the program purposes for which it was collected or to comply with financial and tax retention requirements.
